Changing the training contract
There are various administrative processes that a training organisation is required to undertake. The most common processes relate to completion, cancellation or changing the training organisation.
Completing the school-based apprenticeship or traineeship
The SAT is complete when the training organisation, the employer and the school-based apprentice or trainee agree that all the requirements of the training plan have been met.
All SATs in Queensland are competency-based. This means that when the school-based apprentice or trainee has attained all of the required competencies, they may complete their apprenticeship or traineeship - regardless of time served.
The training organisation is responsible for ensuring that the training delivered by the employer and the training delivered by the training organisation is completed on time and in accordance with the training plan.
The training organisation is also responsible for issuing the qualification or statement of attainment to the school-based apprentice or trainee. In addition, a certificate of completion is issued by the Queensland Department of Education and Training.

Cancelling the training contract
The training contract entered into by the employer and the school-based apprentice or trainee is legally binding.
In certain circumstances, training contracts may be cancelled. The provisions for cancelling training contracts are set out in the Vocational Education, Training and Employment Act 2000. Training contracts may only be cancelled in accordance with the Act. For example:

during probation
-
with agreement of the parties to cancel
-
an inability to perform obligations under the contract.
There are processes that the employer and apprentice or trainee must follow to cancel a training contract.
The training organisation should advise the Department of Education and Training if it becomes aware that a training contract has been cancelled without following the required process or if it believes it is likely a training contract may be cancelled. Changing SRTO
The employer and the school-based apprentice or trainee may agree to change the training organisation during the apprenticeship or traineeship.
The employer must:

write to the training organisation advising them that they are to be replaced, including the date for the replacement (which can be no sooner than 14 days after the date written notice is given)

advise the Queensland Department of Education and Training by completing the Change of training organisation form [PDF 122kb].
In this circumstance, training organisations have certain responsibilities:

Where replaced by an employer and their apprentice or trainee, training organisations must provide a statement of attainment, confirming the training that has been completed under the training plan, on or before the nominated replacement day.

Where a training organisation agrees to become the replacement organisation, they must develop a new training plan and advise the Queensland Department of Education and Training that a new training organisation has been selected.
