Making changes to the training contract

Both the employer and the apprentice or trainee can apply to have some details in the training contract changed, where both parties agree to the change.

Extending the training contract

All apprenticeship and traineeship training contracts have a nominal term, start date and nominal completion date.

If it is unlikely that your apprentice or trainee will complete the training contract by the completion date, you will need to apply to the department for an extension of the nominal term, and amend the training plan.

Temporarily assigning the contract to another employer

An employer who is temporarily unable to perform the duties of ensuring their apprentice or trainee is trained as outlined in the training plan, may temporarily assign the apprentice or trainee to another employer.

Changing employers

If you sell your business, or if the business partnership is dissolved and one or more of the partners agrees to continue the business, your apprentice or trainee can have their training contract assigned to the new owner of the business, if the new owner agrees to continue to train the apprentice or trainee.

To assign the training contract to the new owner, you must advise the department of the new arrangements within 14 days of the transfer of the business. An Assignment/change of legal name form [PDF, 134kb] is available from the department for this purpose.

You will also need to contact your Australian Apprenticeships Centre, to allow updating of their internal records.

If the new owner does not agree to continue training the apprentice or trainee, or the business is not continued, you may need to arrange for the training contract to be cancelled.

Changing the training organisation

You and your apprentice or trainee can agree to change training organisations during the apprenticeship or traineeship. The Change of training organisation form [PDF, 110kb] has been developed for this purpose and includes more information on this process.
